These Terms of Use (“Terms”) govern your use of smogchecktracy.com (the “Website”), operated by 6TH STREET & MACARTHUR SMOG TEST ONLY LLC (“6th St. & MacArthur Smog”) (“we,” “us,” “our”). By using the Website you agree to these Terms. If you do not agree, please do not use the Website.
These Terms apply to the Website. They do not reduce any rights you have under California consumer-protection law or the California Bureau of Automotive Repair’s rules, or in connection with services performed for you at our station, an estimate, an invoice or a smog inspection report.
1. Information is general and may change
Content on the Website — including smog check requirements, exemptions, model-year rules, diesel and hybrid information, certificate information and DMV registration information — is general information. California laws, regulations, fees and procedures change, and the Website may not reflect the latest changes. It is not legal advice. Please confirm your vehicle’s requirements with your DMV notice, the Bureau of Automotive Repair and the California DMV.
2. Inspection results and your responsibilities
We are a California Smog Check Test Only station. We do not guarantee that any vehicle will pass a smog inspection. Inspection results depend on the vehicle’s condition and the requirements that apply at the time of the test, and information on the Website does not promise that a vehicle is eligible for a particular inspection or registration transaction. You are responsible for your vehicle’s registration and for meeting the compliance requirements that apply to it.
3. Test-only station
We inspect vehicles and do not perform repairs. Any repair shop you choose is independent of us.
4. Registration services
We are not the California DMV. We provide certain registration services as a DMV business partner. Please call to confirm that we can handle your specific transaction before you visit. DMV fees are set by the state and are separate from any service fee we charge. Acceptance of any transaction is subject to the DMV’s rules.
5. Coupons and offers
- Current offer: $39.75 for the smog inspection plus the $8.25 California smog certificate fee, which applies when a Smog Check certificate is issued. Offer category: Most Cars & Light Trucks — 2000 & Newer.
- An offer is subject to the terms shown with it, including any stated dates, vehicle eligibility and fee information.
- While an offer is posted as active and within its stated dates, we will honor it on the terms displayed.
- We may change or end an offer going forward at any time. A coupon has no cash value and must be presented before the service begins.
6. Accuracy of information
We work to keep hours, prices, offers and other details current. If you see an error, please tell us. Please call (209) 836-3122 to confirm details before you visit.
7. Intellectual property
Business materials. The business name, logos, photographs of our station, trademarks, business information and original materials describing our services are owned by, or used under license by, 6TH STREET & MACARTHUR SMOG TEST ONLY LLC (“6th St. & MacArthur Smog”).
Website development materials. The Website was designed and developed by Found Sites LLC. It may contain proprietary development technology, original designs, custom software components and other intellectual property that belongs to Found Sites LLC. Ownership of, and licenses to, those materials as between Found Sites LLC and the business are governed by their separate written agreement; nothing in these Terms changes that agreement.
Third-party materials. The Website uses third-party images, software and services, including Google Maps, Google Fonts, Google Analytics and Wix hosting, which belong to their providers and are used under their terms. “STAR” and the names and marks of the California Bureau of Automotive Repair, the California DMV and Google belong to their owners, and their use here does not imply endorsement.
Your use. Visiting the Website does not give you ownership of, or any license to, the materials above. You may view the Website and print or save a coupon for your personal, non-commercial use; other copying or reuse requires written permission from the owner of the material.
8. Acceptable use
You agree not to attempt unauthorized access to the Website, interfere with its operation, introduce malicious code, or use it for any unlawful purpose.
9. Third-party links and services
The Website links to or embeds third-party services (including Google Maps). We do not control and are not responsible for third-party content or practices.
10. Disclaimer (Website)
TO THE EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND WE DISCLAIM WARRANTIES ABOUT THE WEBSITE, INCLUDING THAT IT WILL BE UNINTERRUPTED, ERROR-FREE OR COMPLETELY CURRENT. This section applies to the Website only. It does not disclaim any warranty or right that applies to services we perform for you in person, or that cannot be excluded under California law.
11. Limitation of liability (Website)
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the Website or reliance on its content. This does not limit liability for fraud, willful misconduct, gross negligence or violation of law, liability for services we perform for you in person, or any liability that cannot be limited under California law.
12. Changes and severability
We may update these Terms by posting a revised version with a new effective date. If a provision is found unenforceable, the rest of these Terms remain in effect.
